Denver’s Proposed Gas Station Ban: What It Means for Property Owners
Denver, CO — 02/18/2025 —A new Denver ordinance set for a City Council vote on Feb. 18 could have serious financial consequences for landowners, developers, and small business owners. The proposed measure, BR24-1866, would significantly restrict new gas station development — but the most alarming part is its retroactive clause. NavPoint Director Mike Quinlan was recently quoted in a Bisnow article framing the situation.
“Many property owners purchased land under the assumption that they could sell for any permitted use,” said Mike Quinlan, director at NavPoint Real Estate Group. “New regulations—especially those applied retroactively—create uncertainty and financial challenges for small businesses.”
If passed, the ordinance would apply retroactively to May 13, 2024, meaning any project submitted after that date would be automatically rejected—regardless of prior zoning approvals or investment commitments.
“These changes could prevent property owners who are under contract to sell from completing transactions that were legally allowed when they entered agreements,” Quinlan added. “This creates real financial hardship and raises serious concerns about property rights.”
Industry experts estimate that building a gas station costs between $8M and $12M, and with planning and permitting often taking over a year, many projects that were legally viable could now be dead on arrival. BusinessDen and Denver Business Journal provide further insights on how these changes could reshape commercial real estate.
As restrictions tighten, developers may shift focus to alternative commercial uses such as EV charging stations or mixed-use developments. However, property owners facing unexpected regulation changes could struggle with stranded investments and limited resale options. The outcome of the Feb. 18 vote will be critical in shaping the future of Denver’s commercial real estate landscape.
